Tennessee primarily follows a non-judicial procedure for deed of trust foreclosure. However, if there is no power of sale clause in the deed of trust, judicial foreclosure can be chosen as an option by the lender.
Bids at the public auction of foreclosure sale can be placed after ninety days of the owner of the property receiving the notice of default.
It is not advisable to let the foreclosure property to pass the public foreclosure auction and become a Real Estate Owned property, because properties then generally cost more than they would have during preforeclosure.
