A non-judicial process for deed of trust foreclosures is normally followed in the State of Oklahoma. Judicial foreclosure, though, can be opted for by the lender, if there is no language of power of sale in the deed of trust or if a regular mortgage has been used.
The public auction of foreclosure sale can take place no sooner than ninety days after the day the owner of property receives the notice of default. After the public foreclosure auction sale, if the property in foreclosure is not sold, it becomes a Real Estate Owned property. The price of this foreclosure property does tend to increase when it becomes Real estate Owned; therefore buying it during preforeclosure is the better option.
