A judicial procedure for mortgage foreclosure is predominantly followed in the State of New Mexico. The public auction of foreclosure sale usually takes place only four months after the owner of a property is presented with the notice of default.
Once a foreclosure property is Real Estate Owned, it is, more often than not, more expensive than it was during preforeclosure. Therefore, waiting till the last stage is not advisable.
If the foreclosure property ends up selling for less than the amount that remains on the original mortgage at the public foreclosure auction sale, a deficiency statement is provided to the lender.
