A non-judicial process for deed of trust foreclosure is predominantly followed in New Hampshire. In opposition, a judicial process can be chosen by a lender if there is no power of sale language present in the deed of trust.
A foreclosure property cannot be sold at the public auction of foreclosure sale before sixty days, beginning from the time the notice of default is served to the owner of the property.
Foreclosure properties are known to sell for a lesser amount during the preforeclosure stage; it is therefore not advisable to wait till the Real Estate Owned stage.
