A judicial method is mostly used in North Dakota for mortgage foreclosure. At least three months have to go by after the owner of the property is given the notice of default, before the foreclosure property can be sold at the public auction of foreclosure sale.

In certain situations, a deficiency judgment is provided to the lender. An example in case would be, a deficiency statement being provided for agricultural or commercial property that exceeds forty acres in area, whereas a residential foreclosure involving a property of up-to forty acres of adjacent homestead property is not provided with one.
