The State of Georgia primarily follows a non-judicial system of deed of trust foreclosure. In case the power of sale language is not included in the deed of trust or the mortgage used is a standard one, judicial foreclosure can be sought by the lender.

Once the property owner is served with the notice of default, it would take more than sixty days before the public auction of foreclosure sale can take place.

Waiting till the foreclosure property becomes Real Estate Owned is not suggested because it would generally sell for more than it would have during preforeclosure.
