			<content:encoded><![CDATA[<p><!--Shrn-->Mortgage services have expressed their concerns over the possibility that the 90-day moratorium imposed by the U.S. Congress on <a href="http://www.e-foreclosuresearch.com/" >home foreclosures</a> could just prolong the worsening housing market crisis.</p>
<p>Residential Credit Solutions President Dennis Stowe explains that a moratorium could delay the application of needed corrections and could affect mortgage servicers who are already experiencing liquidity constraints.</p>
<p>Mortgage servicers are required under agreements that cover pooling and servicing to advance all interest and principal payments, including foreclosure and maintenance cost and insurance and tax, to investors whether borrowers are paying or not.</p>
<p>Mortgage servicers can only receive reimbursement for incurred expenses for a delinquent loan after the property has entered foreclosure proceedings. A moratorium would extend indefinitely the payment advances that mortgage servicers give to investors.</p>
<p>The moratorium comes as borrowing facilities, which servicers depend on for advance payments, are experiencing difficulties due to the liquidity crunch.</p>
<p>National Asset Direct Inc. Chief Executive Officer Matt Stadler points out that independent and special mortgage servicers who deal with borrowers who defaulted are currently experiencing financial difficulties and therefore may not be able to pay advances to investors.</p>
<p>Barney Frank, chairman of the House Financial Services Committee argues that a moratorium is needed because mortgage servicers are not doing their best to expedite loan modifications.</p>
<p>Lenders have also voluntarily suspended foreclosures. JPMorgan Chase and Co. imposed a ban on properties financed by EMC Mortgage Corp. unit of Bear Sterans, Washington Mutual Inc. and Chase Home Finance LLC. JPMorgan will also offer financing to borrowers under threat of foreclosures and conduct independent loan reviews.</p>
<p>Figures released by E-Foreclosuresearch showed a 71 percent increase to 765,000 in foreclosure filings for the third quarter of 2008. Meanwhile, Radar Logic Inc.&#8217;s data showed that home sales increased in 19 out of 25 U.S. cities in August 2008.</p>

<li>Forbearance &#8211; extension of payment period and a repayment plan offer</li>
<li>Debt  forgiveness &#8211; a break or waiving of obligation (rarely happens)</li>
<li>Repayment  plan &#8211; missed payments are spread out over a longer term</li>
<li>Note  modification &#8211; changes in your loan terms</li>
<li>Refinance &#8211; adding of back payments to your loan balance</li>
<li>Partial  claim &#8211; making of a separate loan to pay missed payments</li>
</ul>
<p><em>How to Stop  Foreclosures?</em></p>
<p>Once a default notice has been filed, you only  have limited options. If this happens, contact your lender who may then  consider reinstating your loan by giving you time to bring your mortgage  account current. If you cannot settle your missed payments and if the lender will  not cooperate, you still have the following options:</p>

<li>Make a  short sale (if owed amount is greater than home value)</li>
<li>Sign a  Foreclosure&#8217;s Deed-in-Lieu (can lead to the cancellation of foreclosure action  if forgiven by the lender)</li>

			<content:encoded><![CDATA[<p>One thing that comes as a surprise for most Americans is the increase in the number of <a href="http://www.e-foreclosuresearch.com/" >foreclosure homes</a>, located in the nation’s wealthiest neighborhoods. It would seem that the enduring foreclosure crisis has finally arrived at these affluent zip codes.</p>
<p>According to the date obtained by California-based E-Foreclosuresearch, wealthy places such as La Jolla, Carlsbad and Newport Beach have been recording triple-digit foreclosures. Median home sales in these zip codes are over $700,000.</p>
<p>It is not surprising that the foreclosure hotspots are located in California, one of the states hardest hit by the subprime mess. Carlsbad recorded 302 foreclosure homes; La Jolla has 158 foreclosures and Newport Beach posted 89 homes in some stage of foreclosure.</p>
<p>Most of the repossessed properties are actually second homes owned by wealthy individuals. In addition to these second homes, there were also quite a number of foreclosed vacation houses. The owners were no longer able to afford the mortgage payments for various reasons: bonuses and extra earnings that did not fall through or adjustable rate mortgages with interests that recently reset.</p>
<p>Aside from taking out second loans borrowers could not afford, the relatively high foreclosure rate can be attributed to overvaluation during the last housing boom.</p>
<p>Many buyers, in those times, bought homes that were overpriced. Sellers actually incorporated the expected appreciation values into the price. When the housing market began correcting these prices, the homeowners found themselves with mortgage debts larger than the current value of the property.</p>
<p>Lastly, the growing foreclosure rate in these neighborhoods can also be blamed on speculative activities such as betting that the expensive homes will have ready buyers. This is actually the situation in many California foreclosure hotspots, where second-home buyers tried to win the real estate game but ended up overextending themselves and in some cases, eventually lost the property to foreclosure.</p>

<p>According to a recently published report close to 40% of homes sold in California in the second quarter of 2008 were involved in foreclosure. A year earlier this figure stood at 5.4%.</p>

<p>Daniel Mudd, CEO of Fannie Mae said that they are not considering this a good time to hold on to REOs and in order to get foreclosed properties off their books they are pushing hard for sales.</p>
<p>The author of &lsquo;Prospering in the Rising Wave of Foreclosures&rsquo;, Steve Dexter, who has invested in foreclosed properties by the dozen, thinks now is a good time to buy foreclosed homes.</p>
<p>One can buy a home at different phases of the foreclosure process. A home can be bough at the pre-foreclosure stage, at the Sheriff&rsquo;s sale, or once the property has been foreclosed upon (post foreclosure).</p>
<p>When a homeowner is delinquent on his mortgage payment, the home enters the pre-foreclosure stage. When a payment is missed, the lender files a delinquency notice with the county courthouse; making this a good place for a buyer to look for lists of pre-foreclosure homes. A fair amount of instances have come to the fore, where pre-foreclosure homes have gone in for short-sales. Short-sales are where the property sells for lesser than what the homeowner owes on the mortgage. The lender plays a part, where the remainder of the loan amount is forgiven.</p>
<p>Buying a foreclosed property has a person dealing with the bank. This is considered as a safer option by many because not only is the home empty, it also comes with a clear title. Bank owned properties are known to sell for 10-15% lesser than their market values.</p>
<p>Buying at Sheriff&rsquo;s sales can be risky as the homes in question are not open to inspection. The possibility of existent second liens exists. These homes are best left to the experienced home buyer.</p>

In the state that is one of the hardest hit in the country&#8217;s foreclosure crisis, these groups have given more than five hundred families interest free loans of $3,000-$5,000 to help keep them their <a href="http://www.e-foreclosuresearch.com/" >foreclosure properties</a>. With the ongoing mortgage crisis, this is a welcome step.<br />
The loans these organizations provide are targeted at middle class and low income families facing foreclosure proceedings. The fact that these organizations have helped keep 515 families united with their houses is truly commendable, but fact also remains that this is a small percentage of those looking for help.<br />
Neighborhood Housing Services of Greater Cleveland&#8217;s executive director, Lou Tisler, said that this being a start, more tools are required to get out of the crisis.<br />
The Neighborhood Housing Services of Greater Cleveland is one of the eleven organizations that together form the Neighborworks Ohio Foreclosure Prevention Initiative. They dispense the funds from two separate sources, one targets owners whose incomes in comparison with the median income in their community are below or equal to 65%; and the other caters to owners whose incomes are in between 65-115% of the community median.<br />
An additional one million dollars that the state has given through the Office of Housing and Community Partnerships in the Ohio Department of Development is for the program that provides low income homeowners with $3,000 loans. Since inception in 2006, with the state&#8217;s funding of $1.5 million the program helped 400 homeowners.<br />
Ohio Housing Finance Agency&#8217;s program targets middle class families and is in its 2nd year of a $3.1 million stream of state funding that has a 3 year period. This program provides up-to $5,000 loans and has helped 115 homeowners save their homes.</p>

<p>&#8220;Far too often homeowners who try to take action to avoid <a href="http://www.e-foreclosuresearch.com/" >foreclosure</a> are unable to even get their loan servicer on the phone,&#8221; O&#8217;Malley said</p>
<p>On Tuesday this week, together with nonprofit counselors and administration officials, the governor adressed the issue about the busy signals at loan services, long waits and lack of support from the customer services of these loan companies.</p>
<p>&#8220;We need the loan servicers to join with us, not from someplace out in Topeka, Kansas, at a 1-800 number, but here in <a href="http://www.e-foreclosuresearch.com/listings_view.php?state_sg=MD" >Maryland</a>.&#8221;</p>
<p>Countrywide Financial Corp., CitiFinancial and IndyMac Bancorp are confirmed to attend the meeting with the governor. From what we can see the governor is trying hard to help with the foreclosure crisis, as usually when homes are lost everyone is affected, the state and cities loses taxes, home values decline, and everyone suffers, including the mortgage companies.</p>

An 86 percent increase was observed overall compared to last 2006. States that were hit hard were the same ones who have been leading the list of highest foreclosures rate for the past six months.
